Terms & Conditions

Brotech Studio

1. Nature of Service

Brotech Studio is operated by an independent freelance web developer. It is not a registered company or business entity. All services are provided on a freelance, project-based basis. By starting a project with Brotech Studio, you understand and agree to our Terms & Conditions and Maintenance Policy.

2. Payment Terms

  • A 25% advance payment is required to begin any project.
  • The remaining 75% must be paid upon final delivery, before the project handover or deployment.
  • If the client cancels the project after payment, 10% of the total cost will be deducted, and the remaining amount will be refunded within one week.
  • If a signed written agreement was made and cancellation terms were agreed upon, a full refund will be processed as per that signed agreement.
  • Payments are otherwise non-refundable once work has begun.

3. Revisions Policy

  • Each project includes up to 2 rounds of revisions after initial delivery.
  • Additional revisions or major scope changes may incur extra charges depending on complexity.
  • However, if you have an active maintenance plan, it will cover basic revisions such as small design or minor programming updates.
  • Complex design or advanced programming changes are still charged separately even under a maintenance plan.

4. Taxes & Invoicing

  • Brotech Studio is not GST-registered and does not charge any taxes.
  • The invoice provided is only a project cost summary - not a tax invoice.
  • The total mentioned amount represents the final cost for the project with no GST or additional tax applied.

5. Data & Backups

  • If you have an active maintenance plan, Brotech Studio will take weekly backups of your project on a dedicated client-owned drive or email account (managed by us for maintenance).
  • If you do not have a maintenance plan, it is your full responsibility to maintain all project backups and data after delivery.
  • All client data will be securely deleted from our end after project completion and payment.

6. Post-Delivery Responsibility

  • Once the project is delivered and approved, Brotech Studio holds no further responsibility for updates, maintenance, or fixes unless a maintenance plan is active.
  • Further responsibility for updates, maintenance, or future changes is covered only under such a plan — otherwise, it becomes the client’s responsibility.
  • Failure to renew or pay for the maintenance plan will result in all work, changes, maintenance, and backup services being paused until payment is cleared.

7. Ownership & Copyright

  • Full ownership of the final project files is transferred to the client after full payment.
  • If the client fails to pay for ongoing maintenance, all associated work (like updates, backup handling, and server management) will be stopped immediately.
  • Ownership of unpaid projects remains with Brotech Studio until dues are settled in full.

8. Communication & Timelines

  • Project timelines depend on clear communication and timely feedback from the client.
  • Delays in client response, approval, or payment may extend delivery time.

9. Limitation of Liability

  • Brotech Studio is not responsible for website downtime, hosting issues, or third-party integration errors unless covered under an active maintenance plan.
  • Without a maintenance plan, handling such issues is the client’s responsibility.
  • If you request rework or restoration of old work, it will be charged separately based on clear communication and work complexity.
  • Brotech Studio can assist for free with setting up third-party domain names and hosting (agreed beforehand during the project discussion).
  • However, the actual development or technical work related to those services is billable.
  • Domain and hosting platforms are third-party services — Brotech Studio only helps with setup, not their performance or reliability.
